TERMS OF ELECTRONIC SERVICES FOR THE MRBL APPLICATION

1. Providers and roles
The technology operator is INNOVARE GROUP LTD, Companies House 12878269, 7 Bell Yard, London, England, WC2A 2JR, hello@timzy.app ("Innovare"). The business offering and performing booked services is: MARBELLA GC, MRBL, Stowarzyszenie, Andrzeja Ma艂kowskiego 30/1, 70-304 Szczecin, zachodniopomorskie, PL, KRS 0000999517 (Krajowy Rejestr S膮dowy), REGON 523542992, NIP 8522687709, wojciech@mrblgolf.com, +48 606 425 036, https://www.mrblgolf.com (the "Service Provider"). Innovare and the Service Provider are responsible for their respective activities described in these Terms.
2. Electronic services
The application enables account creation and management, browsing offers, managing bookings, receiving operational messages and using features enabled for this instance. Electronic services concern operation of the platform. The in-person or other booked service is supplied by the Service Provider.
3. Technical requirements and security
Use requires a compatible device, current operating system and application version, Internet access and an active email address. Users must protect credentials, provide accurate information and must not submit unlawful content, malicious code or content infringing third-party rights. Data transmission charges depend on the User's network contract.
4. Account and contract
Before creating an account, the User is given access to these Terms and the privacy policy (https://mrbl-3f8cb.web.app/privacy/). Accepting the Terms and creating an account concludes a contract with Innovare for free electronic services. Confirmation of a booking may form a separate contract with the Service Provider on the conditions shown before confirmation. The User must have legal capacity to enter the relevant contract, and a minor may use the application only to the extent permitted by law and with guardian consent where required.
5. Bookings
A booking is submitted after the User selects a service, time and provider and confirms the details. The application should confirm receipt. The price, scope, location, time and material conditions displayed before confirmation take precedence over a general offer description. The Service Provider is responsible for availability and proper performance of the booked service.
6. Cancellation and rescheduling
The User may cancel or reschedule through the available application flow or by contacting the Service Provider. Specific notice periods, fees, prepayment-refund rules or no-show consequences are binding only if clearly displayed before the booking or payment is confirmed and lawful. If no such rule was displayed, the Timzy platform itself does not charge a cancellation or no-show fee and does not retain funds on that basis.
7. Additional features
Electronic payments are not currently active in this instance. If enabled, before payment is confirmed the User will be told whether the full price or part of it is collected as a prepayment, the exact amount and when the balance is due. The free-cancellation deadline, refund rules, any amount that may be retained and no-show consequences will also be displayed. Funds may be collected or retained only under lawful conditions clearly accepted before a paid order is placed.
8. Obligations and liability
Innovare is responsible for operation of the platform as required by law and does not guarantee uninterrupted availability during maintenance, network failure or force majeure. The Service Provider is responsible for its offer, staff, prices, services, products and related complaints. Nothing excludes liability that cannot lawfully be excluded or mandatory consumer rights.
9. Complaints and contact
Technical application issues may be reported to hello@timzy.app. Complaints about a booking, price or performed service should be sent to wojciech@mrblgolf.com, phone +48 606 425 036. A report should describe the issue and allow the account or booking to be identified. A response is provided without undue delay and within the time required by applicable law.
10. Termination and account deletion
The User may stop using the service and delete the account at any time under https://mrbl-3f8cb.web.app/delete-account/. Paid orders should be settled and future bookings cancelled first. An account may be restricted or removed for a material breach of law, security or these Terms, subject to consumer rights and an opportunity to clarify the matter where required.
11. Consumer rights
Information required before a paid contract, including price, trader identity, performance and relevant withdrawal information, must be provided before the order. The scope of withdrawal rights depends on the service, performance date and any request to begin performance before the statutory period expires. These Terms do not replace information supplied for a specific paid order.
12. Intellectual property and availability
Rights in the platform, software and Timzy branding belong to Innovare or its licensors. Rights in the Service Provider's offer, content and branding belong to the Service Provider or its licensors. The application may be updated for security, legal or functional reasons.
13. Changes, governing law and disputes
A new version is published at https://mrbl-3f8cb.web.app/terms/. Material changes affecting an ongoing contract are notified with appropriate notice, and the User may terminate before they take effect where required by law. The law applicable to the relevant provider applies without depriving consumers of mandatory protection in their country. Disputes may be submitted to a competent court or eligible alternative dispute-resolution body.

2. Zakres us艂ug elektronicznych
Aplikacja umo偶liwia w szczeg贸lno艣ci utworzenie i obs艂ug臋 konta, przegl膮danie oferty, zarz膮dzanie rezerwacjami, otrzymywanie komunikat贸w operacyjnych oraz korzystanie z funkcji aktywnych w tej instancji. Us艂ugi elektroniczne dotycz膮 obs艂ugi platformy. Us艂ug臋 wykonywan膮 w salonie, klubie albo innym miejscu 艣wiadczy Us艂ugodawca.
3. Wymagania techniczne i bezpiecze艅stwo
Do korzystania potrzebne s膮 zgodne urz膮dzenie, aktualny system i wersja aplikacji, dost臋p do Internetu oraz aktywny adres e-mail. U偶ytkownik chroni dane logowania, podaje prawdziwe dane i nie dostarcza tre艣ci bezprawnych, z艂o艣liwego kodu ani tre艣ci naruszaj膮cych prawa innych os贸b. Koszty transmisji danych ponosi U偶ytkownik zgodnie z umow膮 z operatorem.
4. Konto i zawarcie umowy
Przed utworzeniem konta U偶ytkownik otrzymuje dost臋p do Regulaminu i polityki prywatno艣ci (https://mrbl-3f8cb.web.app/privacy/). Akceptacja Regulaminu i utworzenie konta prowadz膮 do zawarcia z Innovare umowy o bezp艂atne 艣wiadczenie us艂ug elektronicznych. Potwierdzenie rezerwacji mo偶e prowadzi膰 do zawarcia odr臋bnej umowy z Us艂ugodawc膮 na warunkach pokazanych przed jej zatwierdzeniem. U偶ytkownik musi mie膰 zdolno艣膰 do zawarcia w艂a艣ciwej umowy, a osoba niepe艂noletnia mo偶e korzysta膰 z aplikacji wy艂膮cznie w zakresie dozwolonym przez prawo i za zgod膮 opiekuna, gdy jest wymagana.
5. Rezerwacje
Rezerwacja zostaje z艂o偶ona po wybraniu us艂ugi, terminu i Us艂ugodawcy oraz potwierdzeniu danych. Aplikacja powinna potwierdzi膰 jej przyj臋cie. Cena, zakres, miejsce, termin oraz istotne zasady konkretnej rezerwacji przedstawione przed jej zatwierdzeniem maj膮 pierwsze艅stwo przed og贸lnym opisem oferty. Us艂ugodawca odpowiada za dost臋pno艣膰 i prawid艂owe wykonanie zarezerwowanej us艂ugi.
6. Odwo艂anie i zmiana terminu
U偶ytkownik mo偶e odwo艂a膰 lub zmieni膰 rezerwacj臋 w spos贸b dost臋pny w aplikacji albo kontaktuj膮c si臋 z Us艂ugodawc膮. Szczeg贸lne terminy, op艂aty, zasady zwrotu przedp艂aty lub skutki niestawienia si臋 s膮 wi膮偶膮ce wy艂膮cznie wtedy, gdy zosta艂y jasno pokazane przed potwierdzeniem rezerwacji lub p艂atno艣ci i s膮 zgodne z prawem. Je偶eli takich zasad nie pokazano, sama platforma Timzy nie nalicza op艂aty za odwo艂anie ani niestawienie si臋 i nie zatrzymuje 艣rodk贸w z tego tytu艂u.
7. Funkcje dodatkowe
P艂atno艣ci elektroniczne nie s膮 obecnie aktywne w tej instancji. Je偶eli zostan膮 uruchomione, przed zatwierdzeniem p艂atno艣ci U偶ytkownik otrzyma informacj臋, czy pobierana jest pe艂na cena, czy cz臋艣膰 ceny jako przedp艂ata, jaka jest dok艂adna kwota i termin zap艂aty pozosta艂ej cz臋艣ci. Zostan膮 r贸wnie偶 pokazane termin bezkosztowego odwo艂ania, zasady zwrotu, kwota, kt贸ra mo偶e zosta膰 zatrzymana, oraz skutki niestawienia si臋. 艢rodki b臋d膮 mog艂y zosta膰 pobrane lub zatrzymane wy艂膮cznie na warunkach wyra藕nie zaakceptowanych przed z艂o偶eniem odp艂atnego zam贸wienia i zgodnych z prawem.
8. Obowi膮zki i odpowiedzialno艣膰
Innovare odpowiada za dzia艂anie platformy w zakresie wynikaj膮cym z prawa i nie gwarantuje nieprzerwanej dost臋pno艣ci w czasie konserwacji, awarii sieci lub dzia艂ania si艂y wy偶szej. Us艂ugodawca odpowiada za ofert臋, personel, ceny, wykonanie us艂ug, produkty i rozpatrywanie zwi膮zanych z nimi reklamacji. 呕adne postanowienie nie wy艂膮cza odpowiedzialno艣ci, kt贸rej nie mo偶na zgodnie z prawem wy艂膮czy膰, ani praw konsumenta.
9. Reklamacje i kontakt
Problemy techniczne dotycz膮ce aplikacji mo偶na zg艂asza膰 na hello@timzy.app. Reklamacje dotycz膮ce rezerwacji, ceny lub wykonania us艂ugi nale偶y kierowa膰 do wojciech@mrblgolf.com, tel. +48 606 425 036. Zg艂oszenie powinno opisywa膰 problem i umo偶liwia膰 identyfikacj臋 konta lub rezerwacji. Odpowied藕 jest udzielana bez zb臋dnej zw艂oki, w terminie wymaganym przez w艂a艣ciwe prawo.
10. Rozwi膮zanie umowy i usuni臋cie konta
U偶ytkownik mo偶e w ka偶dej chwili zako艅czy膰 korzystanie i usun膮膰 konto zgodnie z instrukcj膮 https://mrbl-3f8cb.web.app/delete-account/. Przed usuni臋ciem nale偶y rozliczy膰 p艂atne zam贸wienia i odwo艂a膰 przysz艂e rezerwacje. Konto mo偶e zosta膰 ograniczone lub usuni臋te w przypadku istotnego naruszenia prawa, bezpiecze艅stwa albo Regulaminu, z zachowaniem praw konsumenta i mo偶liwo艣ci wyja艣nienia sprawy, gdy jest to wymagane.
11. Prawa konsumenta
Informacje wymagane przed zawarciem odp艂atnej umowy, w tym cena, dane przedsi臋biorcy, spos贸b wykonania i odpowiednie informacje o odst膮pieniu, musz膮 zosta膰 przedstawione przed z艂o偶eniem zam贸wienia. Zakres prawa odst膮pienia zale偶y od rodzaju us艂ugi, terminu jej wykonania oraz 偶膮dania rozpocz臋cia 艣wiadczenia przed up艂ywem ustawowego terminu. Regulamin nie zast臋puje informacji przekazywanych przy konkretnym odp艂atnym zam贸wieniu.
12. W艂asno艣膰 intelektualna i dost臋pno艣膰
Prawa do platformy, jej oprogramowania i oznacze艅 Timzy nale偶膮 do Innovare lub jego licencjodawc贸w. Prawa do oferty, tre艣ci i oznacze艅 Us艂ugodawcy nale偶膮 do Us艂ugodawcy lub jego licencjodawc贸w. Aplikacja mo偶e by膰 aktualizowana ze wzgl臋d贸w bezpiecze艅stwa, prawnych lub funkcjonalnych.
13. Zmiany, prawo w艂a艣ciwe i spory
Nowa wersja Regulaminu jest publikowana pod adresem https://mrbl-3f8cb.web.app/terms/. O istotnych zmianach dotycz膮cych trwaj膮cej umowy U偶ytkownik jest informowany z odpowiednim wyprzedzeniem i mo偶e zako艅czy膰 umow臋 przed ich wej艣ciem w 偶ycie, je偶eli wymaga tego prawo. Stosuje si臋 prawo w艂a艣ciwe dla us艂ugodawcy z uwzgl臋dnieniem bezwzgl臋dnie obowi膮zuj膮cej ochrony konsumenta w jego pa艅stwie. Spory mog膮 by膰 kierowane do w艂a艣ciwego s膮du lub pozas膮dowego podmiotu, gdy prawo przewiduje tak膮 mo偶liwo艣膰.

1. Prestadores y funciones
El operador tecnol贸gico es INNOVARE GROUP LTD, Companies House 12878269, 7 Bell Yard, London, England, WC2A 2JR, hello@timzy.app ("Innovare"). La empresa que ofrece y presta los servicios reservados es: MARBELLA GC, MRBL, Stowarzyszenie, Andrzeja Ma艂kowskiego 30/1, 70-304 Szczecin, zachodniopomorskie, PL, KRS 0000999517 (Krajowy Rejestr S膮dowy), REGON 523542992, NIP 8522687709, wojciech@mrblgolf.com, +48 606 425 036, https://www.mrblgolf.com (el "Proveedor de servicios"). Innovare y el Proveedor responden de sus respectivos 谩mbitos descritos en estas Condiciones.
2. Servicios electr贸nicos
La aplicaci贸n permite crear y gestionar una cuenta, consultar ofertas, gestionar reservas, recibir mensajes operativos y utilizar las funciones habilitadas para esta instancia. Los servicios electr贸nicos se refieren al funcionamiento de la plataforma. El servicio presencial u otro servicio reservado es prestado por el Proveedor.
3. Requisitos t茅cnicos y seguridad
Se requiere un dispositivo compatible, un sistema operativo y una versi贸n de la aplicaci贸n actualizados, acceso a Internet y un correo electr贸nico activo. El Usuario debe proteger sus credenciales, facilitar datos exactos y no enviar contenido il铆cito, c贸digo malicioso ni contenido que vulnere derechos de terceros. Los costes de datos dependen del contrato del Usuario con su operador.
4. Cuenta y contrato
Antes de crear la cuenta, el Usuario puede consultar estas Condiciones y la pol铆tica de privacidad (https://mrbl-3f8cb.web.app/privacy/). La aceptaci贸n de estas Condiciones y la creaci贸n de la cuenta celebran con Innovare un contrato de servicios electr贸nicos gratuitos. La confirmaci贸n de una reserva puede formar un contrato separado con el Proveedor en las condiciones mostradas antes de confirmarla. El Usuario debe tener capacidad jur铆dica para celebrar el contrato correspondiente y los menores solo pueden utilizar la aplicaci贸n en la medida permitida por la ley y con el consentimiento del tutor cuando sea necesario.
5. Reservas
La reserva se env铆a despu茅s de elegir servicio, hora y proveedor y confirmar los datos. La aplicaci贸n debe confirmar su recepci贸n. El precio, alcance, lugar, hora y condiciones relevantes mostrados antes de confirmar prevalecen sobre una descripci贸n general. El Proveedor responde de la disponibilidad y correcta prestaci贸n del servicio reservado.
6. Cancelaci贸n y cambio de fecha
El Usuario puede cancelar o modificar la reserva mediante la funci贸n disponible o contactando con el Proveedor. Los plazos, cargos, reglas de devoluci贸n del pago anticipado o consecuencias por incomparecencia solo son vinculantes si se muestran claramente antes de confirmar la reserva o el pago y son legales. Si no se mostr贸 ninguna regla, la propia plataforma Timzy no cobra por cancelar o no presentarse ni retiene fondos por ese motivo.
7. Funciones adicionales
Los pagos electr贸nicos no est谩n activos actualmente en esta instancia. Si se habilitan, antes de confirmar el pago se informar谩 al Usuario si se cobra el precio completo o una parte como anticipo, el importe exacto y cu谩ndo vence el saldo. Tambi茅n se mostrar谩n el plazo de cancelaci贸n gratuita, las reglas de reembolso, cualquier importe que pueda retenerse y las consecuencias de no presentarse. Solo podr谩n cobrarse o retenerse fondos conforme a condiciones legales aceptadas claramente antes del pedido de pago.
8. Obligaciones y responsabilidad
Innovare responde del funcionamiento de la plataforma en la medida exigida por la ley y no garantiza disponibilidad ininterrumpida durante mantenimiento, fallos de red o fuerza mayor. El Proveedor responde de su oferta, personal, precios, servicios, productos y reclamaciones relacionadas. Nada excluye responsabilidades que no puedan excluirse legalmente ni derechos imperativos del consumidor.
9. Reclamaciones y contacto
Los problemas t茅cnicos pueden comunicarse a hello@timzy.app. Las reclamaciones sobre una reserva, precio o servicio deben enviarse a wojciech@mrblgolf.com, tel茅fono +48 606 425 036. La comunicaci贸n debe describir el problema y permitir identificar la cuenta o reserva. Se responder谩 sin demora indebida y dentro del plazo exigido por la ley aplicable.
10. Terminaci贸n y eliminaci贸n de cuenta
El Usuario puede dejar de usar el servicio y eliminar la cuenta en cualquier momento conforme a https://mrbl-3f8cb.web.app/delete-account/. Antes deben liquidarse los pedidos de pago y cancelarse las reservas futuras. La cuenta puede limitarse o eliminarse por infracci贸n grave de la ley, la seguridad o estas Condiciones, respetando los derechos del consumidor y la posibilidad de aclaraci贸n cuando proceda.
11. Derechos del consumidor
Antes de un contrato de pago deben facilitarse, entre otros, el precio, la identidad del comerciante, la forma de ejecuci贸n y la informaci贸n pertinente sobre desistimiento. El alcance del desistimiento depende del servicio, la fecha de ejecuci贸n y cualquier solicitud de inicio antes de que venza el plazo legal. Estas Condiciones no sustituyen la informaci贸n de un pedido de pago concreto.
12. Propiedad intelectual y disponibilidad
Los derechos sobre la plataforma, el software y la marca Timzy pertenecen a Innovare o sus licenciantes. Los derechos sobre la oferta, contenido y marca del Proveedor pertenecen al Proveedor o sus licenciantes. La aplicaci贸n puede actualizarse por motivos de seguridad, legales o funcionales.
13. Cambios, ley aplicable y litigios
Las nuevas versiones se publican en https://mrbl-3f8cb.web.app/terms/. Los cambios sustanciales que afecten a un contrato en curso se notifican con antelaci贸n adecuada y el Usuario puede terminarlo antes de su entrada en vigor cuando lo exija la ley. Se aplica la ley correspondiente al prestador sin privar al consumidor de la protecci贸n imperativa de su pa铆s. Los litigios pueden someterse al tribunal competente o a un organismo de resoluci贸n alternativa habilitado.
